Neuquén: alleged instigator acquitted in municipal worker’s killing as prosecutors consider an appeal

Two years after the killing of municipal worker Javier Charpentier, a trial court ruling has sparked renewed frustration for the victim’s family. Suyai Contreras—charged as the alleged instigator—was acquitted. Judge Juan Pablo Balderrama said the evidence showed connections between Contreras and the case, but did not support the specific “instigator” role alleged by prosecutors.

According to the decision, the investigation included wiretapped conversations and other material indicating links between Contreras and the two men already convicted as the direct perpetrators, as well as evidence suggesting she provided resources. The ruling also referenced testimony that she may have had control over weapons used in the attack. Even so, the majority held that what was proven pointed to a different scenario than the one charged, and stressed that judges must rule strictly within the legal theory advanced by the parties.

Majority ruling and a possible challenge

The acquittal was issued by a majority vote and also cleared Contreras on a separate allegation connected to a later shooting incident involving a relative of the victim. One judge dissented, arguing there was enough evidence to convict under the prosecution and private accuser’s request. Prosecutors said they are considering filing an appeal to have the acquittal reviewed.

Outside the hearing, Charpentier’s relatives expressed anger and said they felt unprotected, while also reporting repeated threats and harassment.

The homicide took place on February 8, 2024, in Plaza Huincul. Courts found that Matías Emiliano Díaz intercepted Charpentier and fired multiple shots with a 9mm handgun. Díaz and Alberto Alejandro Pérez have already been convicted as the shooter and an accomplice.
